Terms and Conditions of Purchase and Sale

The owner of the Online Store eeny.ee Eeny Fashion OÜ (hereinafter the e-store EENY.ee) is Eeny Fashion OÜ (registry code 12036517), located at Nõmme tee 2, Tallinn 13426.

Validity of the sales contract, goods and price information
The terms of sale apply to the purchase of goods from the e-shop EENY.ee.

The prices of the products sold in the online store EENY.ee are indicated next to the products. The price includes a fee for delivering the goods.

The delivery fee depends on the buyer’s location and the delivery method. The delivery charge will be displayed to the buyer when placing the order.

Information about the goods is provided on EENY.ee directly next to the goods.

Description of payment methods and currencies

In the e-shop, payment is made through a secure payment center with all Estonian, Latvian, Lithuanian and Finnish payment cards and internet bank accounts (Swedbank, SEB, Luminor, LHV, Coop). The settlement currency is EURO. The goods offered in the e-shop include VAT (Eeny Fashion OÜ is liable for VAT).

Eeny Fashion OÜ is the controller of personal data. Eeny Fashion OÜ transfers the personal data necessary for making payments to the authorized processor Montonio Finance UAB, registrikood 3050205122 -le (https://montonio.com/et/kontakt/).

Placing an order
To place an order, you need to add the desired products to your shopping cart. To complete the order, you need to fill in the required fields and select the appropriate delivery method. The amount of the fee is then displayed on the screen, which can be paid by bank transfer or other payment method.

The contract enters into force from the receipt of the amount to be paid to the current account of the e-shop EENY.ee

If the goods ordered cannot be delivered due to expiry of the goods or for any other reason, the buyer will be notified as soon as possible and the money paid (incl. delivery costs) will be refunded immediately, but not later than within 14 days of sending the notice.

Goods delivery
Goods are shipped to all European countries.

*Ordered products generally reach the destination in Estonia within 1-3 working days. If you place an order Mon-Fri before 1 p.m., the products will be usually delivered to the selected parcel machine on the next day (applies to orders within Estonia). NB! During public holidays or major sales campaigns (such as E-Sunday, Black Friday, etc.), we will do our best to get the products to you quickly.

If the order is placed after 1 p.m., we will dispatch the products the next day and they will usually reach you the day after.

Goods are shipped to Latvia and Lithuania via DPD and Omniva parcel machines and courier services. Shipping to Finland is done by DPD and Ite.

How do I receive my parcel?
In Estonia, we use DPD, Omniva and Smartpost parcel terminals and the DPD courier service. DPD, Itella SmartPost parcel terminals and DPD courier service in Latvia and Lithuania; DPD, SmartPost parcel terminals in Finland are used. To other countries, we send the products as a standard package.

Free delivery
Order for at least 39 € and we will pay for the transport (DPD, Itella)! (applies to ordering products from parcel machines in Estonia).

Order for at least 200 € and we'll deliver your parcel directly to your door free of charge (DPD courier).

Parcel delivery charges
Parcel delivery in Estonia: to DPD parcel terminals 2.35 €;
Itella SmartPOST parcel machine 2.75 €;
Omniva parcel machine 2.75 €; DPD courier 4.50 €

Sending a parcel to a DPD or Smartpost parcel terminal in Latvia 5 €, DPD courier 7.50 €.
Sending a parcel to a DPD or Smartpost parcel terminal in Lithuania 7.50 €, DPD courier 9 €.
To a DPD parcel terminals 7.50 €, Smartpost parcel terminals 8 € in Finland.
Other EU countries (standard package) 20 €.
Rest of the world (standard package) 25 €.

International parcel delivery
Goods usually arrive abroad within 1-2 weeks depending on the distance of the country.

In exceptional cases, we have the right to have the goods delivered within a maximum of 30 calendar days (for goods with orders).

Customer's right of withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-shop within 14 days [depending on the products, the buyer may not have the right to withdraw, in which case the products and services must be listed and must meet the conditions listed in § 53(4) of the Law of Obligations Act].

The right of withdrawal does not apply to tights, knee highs and socks once they have been tried on.

The right of withdrawal does not apply to pre-orders. The right of withdrawal does not apply if the buyer is a legal entity.

If the customer withdraws from the contract of their own free will, the shipping and return costs are not refundable.

The product must be posted via DPD, Itella SmartPost or Omniva parcel machine in Tondi Selver (Tallinn), parcel machine within 14 days of receiving the product, mob. +372 53307619. +372 53307619. We will reimburse the customer for the returned products on the same day, but no later than 10 working days from the date the products reach Eeny Fashion OÜ. The cost of returning the goods is borne by the buyer, unless the reason for the return is that the item to be returned does not correspond to what was ordered (e.g. a wrong or defective item).

If the purchaser has expressly chosen a delivery method other than the cheapest delivery method offered by the online shop, the online shop does not have to reimburse the consumer for the cost that exceeds the cost of the standard delivery method.

Condition of the returned product:
In order to benefit from the 14-day right of return, the ordered goods must not be used in any other way than is necessary to make sure of the nature, characteristics and functioning of the goods in a way that is allowed for testing the goods in a physical store.

The item being exchanged or returned must not be damaged or show signs of wear, must be in its original packaging and all original labels must be attached to the product.

The 14-day right of withdrawal does not apply to goods which cannot be returned due to their nature (e.g. stockings, cosmetics, perfumes) and which have been delivered in a sealed package, but whose package has been opened by the customer.

The product to be returned must not be damaged.

If the returned product (and product packaging) has deteriorated and the deterioration is caused by circumstances that are not due to Eeny Fashion OÜ, or the non-intended use of the product, Eeny Fashion OÜ has the right to offset the decrease in the value of the product against the amount paid by you for the product and due to be returned to the customer.

The product to be returned must not show signs of use.

If it turns out that the product has been used, Eeny Fashion OÜ is guided by the principle of reasonable use - if the product had to be tried on to make sure it was not suitable, the product is considered unused (except tights, knee highs, socks). Eeny Fashion OÜ has the right to offset the decrease in the value of the product due to use with the amount paid by you for the product and due to be returned to you.

The product to be returned must be accompanied by price labels.

Eeny Fashion OÜ is not liable for defects that have occurred after the goods have been delivered to the buyer.

The buyer must return the goods within 14 days of the date of the application or provide proof that he has handed them over to the carrier within that period.

The e-shop has the right to withdraw from the sales transaction and to demand the return of the goods from the buyer if the price of the goods in the e-shop EENY.ee is indicated significantly below the market price of the goods due to a mistake.

Right to lodge a complaint
The online store eeny.ee is responsible for the non-compliance of the goods sold to the buyer with the contract conditions or a defect that already existed at the time of handing over the item and that appears within two years from the handing over of the goods to the buyer. Within the first six months from the delivery of the item to the buyer, it is assumed that the defect was already present at the time of delivery of the item. It is the responsibility of EENY.ee to refute this assumption.

The online shop is not liable for defects that occur after the goods have been delivered to the buyer.

If goods purchased from EENY.ee have defects for which the online shop is responsible, the online shop will repair or replace the defective goods. If the goods cannot be repaired or replaced, the online shop will refund to the buyer all fees associated with the sales contract.

The online shop will respond to the consumer's complaint in writing or in a format that can be reproduced in writing within 15 days.

Direct marketing and processing of personal data
The online shop uses the personal data provided by the buyer (including name, telephone number, address, e-mail address, bank details) only to process the order and send the goods to the buyer. The online shop transfers personal data to companies providing transport services in order to deliver the goods.

The Online Store eeny.ee will send the buyer newsletters and offers to the buyer's e-mail address only if the buyer has expressed a wish by entering the e-mail address on the website and has announced his / her wish to receive direct mail notifications.

The buyer may cancel receiving offers and newsletters by email at any time by notifying us by email or by following the instructions in the email containing the offers.

Settling disagreements
If the buyer has any complaints about the EENY.ee e-shop, they should be sent by e-mail toinfo@eeny.ee.We are ready to work with the customer to find a reasonable and best solution to make the customer feel comfortable.

If the buyer and the online store cannot resolve the dispute by agreement, the buyer can appeal to the Consumer Disputes Committee. You can familiarize yourself with the procedural conditions and submit an application here. The Consumer Disputes Committee is responsible for resolving disputes arising from a contract between a buyer and an e-shop EENY.ee. The examination of the buyer's complaint by the Committee is free of charge.

The buyer can turn to the European Union Consumer Dispute Resolution Platform.

Liability and force majeure
Eeny Fashion OÜ is responsible to the buyer, and the buyer is responsible to Eeny Fashion OÜ to the other party for the damage caused by the violation of the terms of this contract in the cases and to the extent provided by the legislation in force in the Republic of Estonia.

Eeny Fashion OÜ shall not be liable for any damage caused to the buyer or for any delay in the delivery of the product if the damage or the delay in the delivery of the product is due to a circumstance beyond the control of Eeny Fashion OÜ and which Eeny Fashion OÜ did not foresee and could not have foreseen (force majeure).

Eeny Fashion OÜ is not liable for loss or damage to the product that has occurred after the product has been delivered to the carrier.

Eeny Fashion OÜ is responsible for the buyer to the extent of the selling price of the product.

Eeny Fashion OÜ does not take responsibility for damages caused by defective products, such as damage to property or information, loss of turnover or profit.

Consumer's right to appeal to the Consumer Disputes Committee
If the online store has refused to resolve the consumer's complaint or the consumer does not agree with the solution offered by the online store and considers that her/his rights have been violated or her/his interests have been harmed, the consumer can file a complaint with the Consumer Disputes Committee through the Consumer Protection Board or the court. If the consumer has made a written complaint to the online shop but has not received a reply within 15 days, the consumer can turn to the Consumer Protection Board. If the consumer is located outside the Republic of Estonia, it is possible to lodge a complaint with the European Consumer Centre in the Member States of the European Union.
